Adult Use Cannabis in Arizona
Arizona passed the Safe and Smart Act, Proposition 207, into law with a voter initiative in November of 2020 to legalize cannabis for adult recreational use. The law allows adults 21 years of age and older to purchase, possess, process, and transport up to one ounce (28 g) or less of cannabis or 5 grams or less of concentrate. It is illegal to possess more than the allowed limit or to smoke cannabis in public.
The Arizona Department of Health Services (ADHS) is responsible for the regulation and licensing of all cannabis growth, retail sales, and testing facilities in the state. A 16% excise tax is added on top of the transaction privilege tax (TPT) for adult-use cannabis sales in Arizona.
Medical Cannabis Program in Arizona
Arizona established a medical cannabis program in 2010 with a narrow margin, barely over 50%. Proposition 203 was a citizen initiative addressed to the AZ Dept. of Health Services that created the medical cannabis program. The number of registered patients fell from approximately 200,000 to just over 127,000 in 2022, presumably due to the passing of the recreational bill. Medical patients in AZ, however, have varying rules, such as the ability to possess up to 2.5 ounces with a written certification from a physician.
Medical cannabis in AZ is certified by physicians to alleviate symptoms associated with a variety of conditions such as cancer, Crohn’s disease, Hepatitis C, AIDS, glaucoma, and other illnesses.
Growing Cannabis in Arizona
As part of the medical cannabis program, patients who live more than 25 miles away from a dispensary have been allowed to grow up to 12 plants at their homes for their own personal medical use. They have to be kept away from the view of the public.
With the passing of Prop 207 in 2020, adults over 21 can now cultivate up to 6 plants in their homes with a limit of 6 per household, no matter how many people over 21 reside in the home, that must also be kept away from public view and preferably in a locked area. Commercial cultivation in Arizona must also grow in an enclosed and secured space.
